Meta Mobilite Enerji A.Ş. (“Q CHARGE”) takes the protection and privacy of personal data of its users (“User(s)”) who benefit from our services seriously. We would like to inform you that your personal data is processed and stored in accordance with the Personal Data Protection Law No. 6698 (“KVKK”). This Personal Data Protection and Privacy Policy (“Policy”) aims to provide information about the personal data collected, stored, processed, shared, and transferred by Q CHARGE. Q CHARGE users are within the scope of this Policy.
1. Personal Data Collected by Q CHARGE
When you use the services provided by Q CHARGE, the following information is collected: Your account information, name, surname, phone number, email, payment card information (if provided), T.C. ID number or passport number, and your address. Location data collected during the use of the application (this information is required to carry out the transaction via the charging station at the relevant location when users wish to perform a transaction). Request and complaint management data (this data is collected when a user contacts customer service via the website’s https://qcharge.io/Bize-Ulasin section or the “contact with customer representative” section in the profile page of the app). This data is processed for the purpose of providing the services we offer and is limited to this purpose.
2. Purpose of Using the Information
Q CHARGE uses the information it collects about users primarily for the following purposes:
- Conducting necessary operations by our business units to provide the services offered by Q CHARGE,
- Completing users’ membership procedures,
- Resolving user problems and complaints,
- Carrying out and sustaining our operations,
- Customizing our services according to users’ preferences, usage habits, and interests,
- Managing financial and accounting processes related to payments,
- Processing users’ information in accordance with relevant legislation.
3. Users’ Rights
As a user, you are entitled to the following rights under Article 11 of KVKK:
- Learn whether your personal data is being processed,
- Request information if your personal data has been processed,
- Learn the purpose of processing your personal data and whether they are used in accordance with that purpose,
- Know the third parties to whom your personal data has been transferred, domestically or internationally,
- Request correction of your personal data if they are incomplete or inaccurate, and ask for the notification of this correction to third parties to whom the data has been transferred,
- Object to the processing of your personal data in a way that leads to a result against you, solely through automated systems,
- Request compensation if you suffer damage due to unlawful processing of your personal data.
4. Storage and Protection of Your Information
Personal data is stored by Q CHARGE for the duration specified in the relevant legislation and in accordance with legal obligations. If there is no specific retention period stated in the legislation (especially in KVKK), personal data is processed for the duration required by Q CHARGE’s activities, after which it is deleted, destroyed, or anonymized. Personal data that is no longer needed or has been requested to be deleted or anonymized by the data subject, may be retained solely for the purpose of potential legal disputes or to assert related rights or defenses. Q CHARGE determines the storage period based on statutory limitation periods.
5. Sharing Your Information with Third Parties
The information you provide to Q CHARGE may be shared with third parties, as required by the KVKK’s Articles 8 and 9, for the purposes mentioned above (for example, to provide technical support, your information may be shared with the company providing this service). Your information may be shared with our business partners and suppliers for support in product/service procurement. Furthermore, if required by legal obligations, your information may be shared with authorized persons, institutions, and organizations.
6. Accuracy and Currency of Your Information
The data within Q CHARGE is processed as declared by the individuals involved. Q CHARGE does not investigate the accuracy of the data provided by users or individuals contacting Q CHARGE, as it is accepted as true. The accuracy and currency of personal data are principles adopted by Q CHARGE. The company updates personal data processed from official documents it receives or upon request from the relevant individual, taking necessary precautions.
7. Third-Party Links
Our service may contain links to third-party websites. Clicking on third-party links will direct you to an external site. These external sites are not operated by us. We recommend that you read the terms and conditions and privacy policies of these sites carefully. Q CHARGE is not responsible for the content, terms of service, or privacy policies of third-party sites.
8. Changes to the Mobile Application and This Policy
Q CHARGE reserves the right to make changes and updates to this Policy. It is the user’s responsibility to follow the updated version of the Policy.
9. Your Rights Regarding Processed Data
To exercise your rights regarding the data processed and obtained, you may submit your request by filling out the Relevant Person Application Form and sending it by hand to Saray Mahallesi Sanayi Caddesi B Blok No:54 İç Kapı No:6 Ümraniye/İstanbul, or electronically with an e-signature or mobile signature to metamobiliteenerji@hs01.kep.tr or via email to kvkk@qcharge.io. Your request will be concluded free of charge within the shortest time and no later than 30 (thirty) days. However, if the process requires a cost, a fee will be charged according to the rate set by the Personal Data Protection Board. If your request is rejected, the reason(s) for the rejection will be communicated to you within 30 (thirty) days.
